Online Booking Terms

By proceeding with a booking, submitting an online request, paying a technical visit fee, paying a deposit, or otherwise engaging CNG Contracting (“CNG”, “we”, “us”, “our”), you (“the Client”) expressly acknowledge and accept these Terms & Conditions. Your actions also signify your consent to our Privacy Policy and agreement with the online booking authorization language as displayed on our website. Where a separate signed contract exists, its written terms will take precedence only to the extent that they expressly modify these Terms.
1. Definitions & Scope
- Technical Visit: A scheduled site visit where CNG reviews the property, work area, access conditions, project details, measurements, visible issues, and/or service requirements before confirming pricing, scope, or next steps.
- Technical Visit Fee: A fee paid by the Client to reserve a technical visit. This fee covers scheduling, travel, fuel, technician time, site assessment, and professional evaluation.
- Online Request Without Payment: A booking request submitted without paying the technical visit fee. This option allows the Client to request contact from CNG, but it does not guarantee or reserve the appointment date or visit time.
- Handyman Services: Repair, adjustment, installation, and maintenance tasks completed within a single visit or short duration, typically two to four hours, depending on the work required and site conditions.
- Major Renovations or Projects: Multi-day or multi-trade undertakings involving construction, structural improvements, demolition, material procurement, subcontractors, permits, inspections, or phased billing.
- Eligible Approved Project: A project approved by the Client and accepted by CNG with a minimum value of $1,000 CAD before taxes, unless CNG confirms a different arrangement in writing.
- These Terms apply to all residential and commercial work carried out by CNG within Ontario, unless a written contract expressly modifies them.
2. Company Policy
- Compliance: All work is performed in accordance with applicable Ontario laws, including the Ontario Occupational Health & Safety Act, Building Code Act, and any applicable municipal permit requirements.
- Insurance: CNG maintains commercial general liability and business insurance. Clients must maintain their own property insurance for pre-existing conditions, third-party claims, contents, personal property, and conditions not caused by CNG.
- Professional Conduct: All CNG staff and subcontractors must act professionally and take reasonable care to protect client property. Any concerns may be reported to info@cngcontracting.com.
- No Free On-Site Visits: CNG does not guarantee free on-site visits. Technical visits require time, travel, fuel, scheduling, and professional evaluation. A technical visit fee may be required before CNG attends the property.
3. Privacy & Data
CNG collects personal information including name, contact details, property address, payment information, project details, descriptions, photos, and related communications only as required to manage bookings, services, permits, inspections, scheduling, billing, and customer support. Data is disclosed solely to personnel, subcontractors, municipal authorities, payment processors, or service providers directly involved in the project or booking process. CNG does not sell or rent personal data. All data is safeguarded, retained as required by law, and securely destroyed thereafter. 4. Booking, Requests, Estimates & Quotes
- Online Booking Information: Online booking may require the Client’s full name, email, phone number, service address, description of work, preferred appointment window, photos, billing details, and acceptance of these Terms.
- Paid Technical Visit: When the Client pays the technical visit fee online, CNG will reserve the selected appointment window, subject to availability, service area, weather, emergency delays, access conditions, and confirmation by CNG.
- Request Without Payment: When the Client submits a request without payment, the request is not a confirmed appointment. CNG may contact the Client by phone, email, or message to review the details. The visit date and time are not guaranteed until CNG confirms the appointment and, where required, receives payment of the technical visit fee.
- Estimates and Quotes: Written estimates or quotes are valid for fifteen (15) days unless otherwise stated. Pricing may change if the scope, materials, site conditions, access, measurements, hidden conditions, or Client instructions change.
- Site Review Required: Any pricing provided before a technical visit is preliminary only unless CNG expressly confirms it in writing as a fixed quote.
- Acceptance: Acceptance of these Terms occurs when the Client checks the consent box, submits a booking request, pays a technical visit fee, pays a deposit, accepts a quote, or directs CNG to begin work.
5. Technical Visit Fee, Payment, Deposits & Final Invoices
- Technical Visit Fee: CNG may charge a technical visit fee before attending the property. This fee covers scheduling, travel, fuel, technician time, site assessment, and professional evaluation. It is not a free estimate, free labour credit, or automatic refund.
- Handyman Bookings: Handyman bookings may require a booking or technical visit fee of $250 + HST ($282.50 total), unless otherwise stated in writing by CNG. This fee covers scheduling, travel, and a standard service call or technical assessment, depending on the nature of the request.
- Credit Toward Approved Project: When a Client pays a technical visit fee, that amount may be credited toward the final invoice only if the Client approves an eligible project with CNG. To qualify for this credit, the approved project must have a minimum value of $1,000 CAD before taxes, unless CNG confirms a different arrangement in writing.
- No Cash Refund or Automatic Credit: The technical visit fee is not a cash refund, rebate, or automatic discount. The credit applies only toward an eligible approved project and does not apply automatically to small service calls, minor repairs, short-duration tasks, declined estimates, no-shows, cancellations, or work below the minimum project value.
- Small Jobs and Exceptions: For small repairs or jobs under $1,000 CAD, Clients should contact CNG before booking to confirm how the technical visit fee will be handled. Any exception must be confirmed by CNG in writing before the appointment or before work begins.
- Major Renovations: Major renovations or larger projects may require a deposit of 30%–50% of project value before procurement, scheduling, subcontractor coordination, permits, demolition, or construction begins.
- Payment Terms: Payment is due immediately upon substantial completion of work unless otherwise agreed in writing.
- Deposit Policy: Deposits are non-refundable once received and applied toward scheduling, procurement, permits, materials, administration, subcontractors, or project preparation.
- Accepted Payments: CNG may accept e-transfer to info@cngcontracting.com, cheque, credit card, or other approved payment methods. Processing fees may apply.
- Overdue Accounts: Overdue accounts may incur collection fees, interest, legal costs, or liens under the Ontario Construction Act where applicable.
6. Cancellation, Rescheduling & Non-Refund Policy
- Technical Visit Cancellation: The technical visit fee is used to reserve time, schedule personnel, and cover business costs related to the visit. Cancellation eligibility depends on timing, costs already incurred, and CNG’s confirmation in writing.
- Handyman Services: Where a $250 + HST booking fee has been paid, the fee is non-refundable except as expressly stated by CNG in writing. Cancellations made more than 24 hours before the appointment may receive a partial refund of $182.50, with CNG retaining $100 for scheduling and administrative costs. Cancellations within 24 hours, missed appointments, no-shows, or lack of site access receive no refund.
- No-Show or No Access: If CNG attends the property and the Client is unavailable, the property cannot be accessed, the work area is not ready, or the Client provides incorrect address or access information, the visit may be considered completed and the fee will not be refunded.
- Rescheduling: CNG may allow rescheduling at its discretion when reasonable notice is provided. Repeated rescheduling, late rescheduling, or same-day changes may require a new technical visit fee.
- Major Renovations: Deposits become fully non-refundable once procurement, permits, subcontractor coordination, scheduling, demolition, or project preparation begins. Cancellations within 10 days of the scheduled start date may incur an $800 closing fee plus costs of materials, permits, administration, subcontractors, and any non-recoverable expenses. Restocking fees of 35% + tax may apply to returnable materials.
- Obligation: Clients remain responsible for all costs incurred by CNG up to cancellation, including labour, administration, materials, permits, delivery fees, supplier charges, subcontractor costs, and third-party fees.
- Refund Timing: Where a refund is approved by CNG, refunds are issued within 14 business days to the original payment method where possible, after deducting applicable fees and costs.
7. Scope Changes, Variations & Extra Work
Any change to the original scope must be approved in writing by email, text message, signed change order, invoice approval, or other written confirmation accepted by CNG. Additional work is billed separately and may require further deposits or payment before proceeding. Hidden or unforeseen issues, including structural damage, mould, rot, water damage, unsafe wiring, plumbing defects, framing issues, code deficiencies, pest damage, concealed damage, or inaccessible conditions, will be assessed and priced before proceeding where reasonably possible.
CNG is not responsible for completing additional work that was not included in the original estimate, quote, booking description, or written agreement. Client requests made during a visit or project may increase cost and extend timelines.
8. Client Responsibilities & Site Conditions
- Access: The Client must provide safe and reasonable access to the property, work area, utilities, parking, and any required building entry systems.
- Work Area: The Client must remove valuables, fragile items, furniture, personal belongings, pets, and obstructions from the work area before CNG arrives.
- Accurate Information: The Client must provide accurate descriptions, photos, measurements, access instructions, building rules, parking information, and known issues before the appointment.
- Condo or Building Rules: The Client is responsible for informing CNG of condo rules, elevator bookings, loading dock requirements, parking restrictions, security procedures, work-hour restrictions, and property management requirements.
- Unsafe Conditions: CNG may refuse, suspend, or reschedule work if the site is unsafe, inaccessible, unsanitary, structurally compromised, or unsuitable for the requested service.
9. Warranties, Defects & Limitations
- Labour Warranty: CNG provides a 30-day labour warranty from completion for eligible work performed directly by CNG, unless otherwise stated in writing.
- Materials Supplied by CNG: Materials supplied by CNG may carry a 30-day warranty from completion, subject to supplier/manufacturer terms and normal use.
- Renovation Division: Renovation, plumbing, electrical, HVAC, or specialized trade work may carry different warranty periods when expressly stated in a written contract, invoice, or applicable trade documentation.
- Exclusions: No warranty applies to client-supplied materials, third-party modifications, pre-existing issues, normal wear and tear, misuse, lack of maintenance, hidden conditions, water intrusion, mould, movement of existing structures, manufacturer defects, or work altered by others.
- Warranty Access: The Client must provide CNG a reasonable opportunity to inspect and correct any alleged defect before hiring another contractor or claiming reimbursement.
- Warranty Remedy: CNG’s obligation for valid warranty claims is limited to repair, replacement, or refund, subject to the liability limits in these Terms.
10. Limitation of Liability, Indemnity & Liability Cap
- Liability Cap: To the maximum extent permitted by law, CNG’s total liability shall not exceed 10% of the total payments made by the Client for that specific service or project giving rise to the claim.
- Exclusion: CNG is not liable for indirect, incidental, punitive, special, or consequential damages, including loss of use, loss of profits, loss of rental income, inconvenience, emotional distress, loss of property value, or business interruption.
- Indemnity: Clients agree to indemnify and hold CNG harmless against claims, damages, costs, and expenses resulting from client-supplied materials, incorrect information, unsafe site conditions, third-party work, pre-existing conditions, building deficiencies, or Client instructions.
- Insurance: The existence of insurance does not expand CNG’s liability beyond the limits stated in these Terms or any written contract.
- Consumer Rights: Nothing in these Terms is intended to exclude or limit rights that cannot be excluded under applicable Ontario consumer protection laws.
11. Dispute Resolution — Mediation & Arbitration
- Disputes should first be addressed through good-faith communication, review of the written scope, and, where appropriate, a site inspection.
- If unresolved after 30 days, disputes may proceed to mediation or arbitration under Ontario’s Arbitration Act, 1991, unless applicable law requires another process.
- Parties waive court and jury trials to the extent permitted by law. Consumer statutory rights remain unaffected.
- Each party bears its own mediation costs unless otherwise agreed. Arbitration costs are assigned by the arbitrator where applicable.
- The English version of these Terms governs in case of translation discrepancies.
12. Termination & Suspension of Work
- Termination by CNG: CNG may suspend or terminate services for non-payment, unsafe conditions, abusive conduct, lack of access, breach of these Terms, unavailable materials, permit issues, or Client failure to approve required changes.
- Termination by Client: If the Client terminates work after approval, the Client remains responsible for all costs incurred by CNG up to the termination date, including labour, administration, materials, permits, scheduling, subcontractors, supplier fees, and non-refundable expenses.
- Subcontractors: CNG may engage subcontractors, licensed trades, suppliers, or specialists when appropriate and remains responsible for coordinating their work within the agreed scope.
13. Third-Party Products, Suppliers & Permits
- CNG disclaims liability for defects, delays, incompatibility, missing parts, warranty issues, or failures related to client-supplied materials, fixtures, appliances, or products.
- Clients are responsible for paying all permit fees unless otherwise agreed in writing.
- CNG may assist with permits, inspections, supplier coordination, or administrative requirements for a $250 + HST administration fee, unless otherwise stated in writing.
- Delays caused by municipal authorities, inspectors, suppliers, manufacturers, weather, utility providers, building management, or regulatory authorities are considered excused delays.
- Material pricing and availability may change. Quotes may be revised if suppliers change prices, discontinue products, delay delivery, or substitute materials.
14. Online Payments, Authorization & Booking Consent
- By submitting payment online, the Client confirms that they are authorized to use the selected payment method and authorize CNG or its payment processor to charge the amount shown at checkout.
- Online payment of a technical visit fee does not mean the full project price has been paid. The final project cost, if any, will be confirmed after review, quote, estimate, or written agreement.
- Payment of a technical visit fee does not obligate CNG to perform work that is unsafe, outside scope, unlawful, unavailable, unsuitable, or not accepted by CNG.
- Submitting an online request without payment does not reserve a technician, guarantee a visit, or create an obligation for CNG to attend the property.
- By checking the consent box, the Client confirms that they have read and accepted these Terms, including the technical visit fee policy, cancellation policy, non-refund terms, credit conditions, and minimum project value requirement.
15. Miscellaneous
- If any clause is invalid or unenforceable, the remainder of these Terms remains effective.
- These Terms, along with any written estimate, quote, invoice, booking confirmation, change order, or contract, constitute the entire agreement between the parties.
- CNG may assign rights or obligations to an affiliate, subcontractor, insurer, collection agent, or successor where appropriate. Clients require written consent to assign their rights or obligations.
- Official notices should be sent to info@cngcontracting.com or to CNG’s physical business address where applicable.
- CNG may update these Terms from time to time. The version displayed at the time of booking or project approval will generally apply unless otherwise required by law or written agreement.
16. Acknowledgment & Acceptance
By submitting a booking request, paying a technical visit fee, paying a deposit, accepting a quote, or directing CNG to begin work, the Client confirms full understanding and acceptance of these Terms, including technical visit fees, minimum project value requirements for credit, limitations of liability, cancellation provisions, payment obligations, and dispute resolution methods.
The Client understands that a technical visit fee is not a cash refund, not a free labour credit, and not automatically applied to small jobs. The fee may be credited toward an eligible approved project of $1,000 CAD or more before taxes, unless CNG confirms a different arrangement in writing.
17. Final Legal Disclaimer
This document is intended to protect all parties but does not replace legal advice. Certain consumer rights under Ontario law cannot be excluded or modified by contract. Clients should obtain independent legal advice if they have questions about their rights or obligations before proceeding with a booking, payment, deposit, or project approval.
